A Lasting Power of Attorney (LPA) is a legal document which allows you to appoint a spouse, relative, friend or professional person to be your Attorney(s) as a safeguard for your future.
LPAs are most important to have in place if in the future, for any reason, you had difficulties or lost the capacity to manage your affairs.
There are two types of LPA - one which covers your property and financial affairs (often used for convenience as you get older) and one which covers your Health & Welfare (if you lost mental capacity in the future).
Please note that it is essential that LPAs are registered at Office of the Public Guardian because without them being registered they cannot be used under any circumstances.
As soon as a Property & Financial Affairs LPA is made, the donor can decide whether it can be used as soon as it is registered or only when they have lost mental capacity.
A Health & Welfare LPA can only be used once the donor has lost mental capacity.
We can advise and assist in respect of your own affairs or those of an elderly relative or friend in your care.
If you would like to talk about making LPAs, please telephone Nadine Forrester at our office on 01782 599577 and they can advise on the next steps.
For both a Financial & Property LPA and a Health & Welfare LPA, our fees are as follows:
One Person (2 LPAs in total) - £490 plus VAT of £98 = £588
Two People (4 LPAs in total) - £660 plus VAT of £132 = £792
LPA Registration Fees
The fees to register the LPAs at the Office of the Public Guardian are as follows:
If the Donor's gross annual income is above £12,000 the fee is £82 per LPA .
If the Donor's gross annual income is below £12,000 the fee is £41 per LPA.
A donor may be entitled to an exemption of fees based on receipt of certain means-tested benefits when an application to register is made. Please ask for more information.
